Ross was indicted by the Franklin County, Ohio Grand Jury on April 27, 1979 for the murder of her common-law husband Charles Yarborough. Trial commenced in February of 1980 in Franklin County Common Pleas Court. Ross testified in her own behalf. She did not deny that she had in fact shot and killed Yarborough, but maintained, alternatively, that the shooting was an accident or an act in self defense. At the close of the evidence, the trial court dismissed the murder charge and submitted the case to the jury on the lesser included offenses of voluntary manslaughter, involuntary manslaughter and negligent homicide.
