Plaintiff, Virgia Benway, brought this action in Merced County, setting up in her complaint that she had, on April 8, 1942, obtained a judgment against defendant in the State of Washington, in the sum of $3,991.66, no part of which had been paid. Defendant filed an answer denying the allegations of the complaint and setting up as a separate defense that the Washington court did not have a jurisdiction over the person of defendant or any property belonging to him, and that the judgment entered by said court was without jurisdiction.
